Bankruptcy is a necessary tool in an orderly society. For our purposes bankruptcy is defined as a legal proceeding involving a person or business that is unable to timely pay outstanding debts.
The reason for bankruptcy is to have a legal peaceful way to adjust debts between individuals and business entities. Without it violence and aggressive behavior would be more rampant in our society. People could use guns and muscle to collect debts. You see examples of loan sharks in the movies that will break your knee cap or kill you if you do not pay them on time.
Before America was founded, the English government would put people in jail until their debts were paid. If the prisoner’s family could not pay the debt, the person would stay in jail for years.
In the early 1700’s England had thousands of people in jail for debt. It cost the government a lot of money to house and feed them. In the 1730’s a wealthy philanthropist, James Oglethorpe came up with idea to help those debtors in jail to get a fresh start and to help England.
Oglethorpe and several other wealthy investors persuaded the King of England to allow them to establish a buffer colony named Georgia with the people from the Debtors’ prisons to protect South Carolina from the Spanish, French and Indians. When America established its independence from England and our constitution was drawn up, it had provisions for a system of bankruptcy laws so that people would not be put in prison just for debt.
