The facts and debt situation is different for each person or couple. In order to give you the best advice when we meet, we will need to have complete information. The following forms have been prepared for you to fill out before your free consultation so that we can give you definite, reliable answers and advice in your personal situation.

The omission of debts and income can not only prevent us from giving you the best advice, but also if a case is later filed and you intentionally failed to fully disclose your financial assets and liabilities it could lead to criminal prosecution by the Federal Bureau of Investigation.

This is not meant to scare you as NO ONE has a perfect memory, but it is important that you make full disclosure of your true financial situation to the best of your knowledge.

The consultation is free and confidential. If after our consultation and your full disclosure it is determined that you would lose something that you want to keep or have other circumstances that would make filing a case a problem for you, I will tell you. You will be under NO obligation to file a case or come back to see me. As much as possible, I like happy and satisfied clients. I will explain to you your options and it will be your decision whether to take any further actions after the initial consultation.

PART TWO

To get a case started as soon as possible, there are certain documents and other information required under the law to file a bankruptcy case. Part One above are the forms we need and Part Two are the backup documents needed in most cases. The seven links below describe the additional documents we need to add to the information in the forms above in Part One.

(1) CREDIT COUNSELING REQUIREMENT
Every person filing a consumer bankruptcy case in the country must take a “Pre-bankruptcy credit counseling course”. This is a specific course that has been approved by the United States Trustee. The pre-bankruptcy course can be taken over the phone or over the internet. The current usual cost varies between $5.00 and $50.00. This can be paid by debit card but not by credit card.

Upon completion of the course you can print one and/or have them e-mail us a copy of the certificate at Rhymerlaw@aol.com . If husband and wife file a case, they can take the course at the same time and should only be charged one fee by the counseling agency.

(2) COPY OF MOST RECENTLY FILED TAX RETURNS
Under the bankruptcy code, we are required to let the bankruptcy trustee see a complete copy of your most recent income tax returns. Please bring a complete copy of your most recent federal and state tax returns when you come to the office. If you have any questions, call us at 404-483-3328.

(3) COPY OF CREDIT REPORTS

(4) COPY OF ANY LEGAL ACTIONS
In order to stop legal actions against you, including lawsuits, garnishments and levies, we need copies of the actual legal papers filed against you. If you are unsure of how many legal actions have been filed and by whom, you can go to the office of the Clerk of the Superior Court of the county in which you live and should be able to get a copy of lawsuits, judgments, liens, etc., that may have been filed against you.

(5) COPY OF MOST CURRENT COUNTY TAX APPRAISALS
In Chapter 7 and Chapter 13 bankruptcy cases, the trustee can require that you furnish a copy of the county tax appraisal on any land or property that you own. Please bring a copy of the most recent county tax appraisal on any house, land or other property in which you may have a legal interest whether you own all or just part of it. This includes any property you may have inherited even if the property has not been recorded in your name in the county deed records. If you have a question, please call our office at 770-483-3328.

(6) COPY OF MONTHLY BANK STATEMENTS
Please bring a copy of the last three monthly statements from any bank account or credit union account that has your name on it, including but not limited to checking, savings, money market etc.
